And are protected from misappropriation , misuse , editing and unauthorized under U.S Copyright Laws and International Copyright treaties , along with any laws that protect intellectual property rights and digital distribution of the above mentioned images.
The artist reserves all rights to use any artwork that has been commissioned to advertise her work.
Promotional Use : You may use the artwork displayed on a non-commercial basis as examples of the artist's work.
As per example on Tumblr or Pinterest. All work must remain intact . No editing or recreating my images.
With the exception of Logo's , as Logo's are the property of Client , once Logo is completed.
Please ask about my availability to create custom work , as I limit the amount of Clients and Projects I take on. Each project I devote the minimum of 30 days . Larger projects will require more time , which will be discussed prior to accepting commission.
Anyone found in possession of the artist's work for commercial use is subject to copyright infringement as well as fees and fines aloud under the law , paying $3000.00 per image per incident .Individuals must sign and agree upon and pay any fees due to Illustrator i.e Elizabeth Forero - Schoonmaker. Anyone using any of my illustrations , drawings or images for commercial use must hold a license in advance as well as pay any fees and terms agreed upon before hand . Any artwork displayed outside of GrafittiCouture.com and www.zazzle.com/grafitticouture must contain a line of credit stating that Elizabeth Forero Schoonmaker is the Illustrator , artist or designer. Anyone given permission or license to use the artists artwork is subject to these policies.
Payment : Invoices are payable on receipt. Unpaid invoices are subject to a monthly re-billing fee of ten percent ( 10 % ) of the unpaid balance. Licenses that are cancelled thirty (30) days after invoice date are payable in full whether images will be used or not. Client acknowledges that in the event that Client cancels theProject , the Artist will incur expenses and a financial loss . Therefore Client acknowledges agrees to notify the Artist of a cancellation at least ten (10 ) days prior to the Project commencement date in order to minimize the Artist's costs , expenses , and loss of income . In the event that Client cancels this agreement before ten ( 10 ) days prior to the date of commencement of Assignment , Client agrees topaz a cancellation fee in amount of fifty percent (50 % ) of the creative fee in addition to all other costs incurred to the Artist. Project and inability to pay the Artist to create services during time reserved for Client , if Artist receives notification of Client's Cancellation of Project hereunder seventy - two ( 72 ) hours or less prior to date of scheduled commencement of the Project , Client shall be responsible for 100 % of creative fee.
Said Cancellation fees are designed to cover loss that the Artist would not otherwise have incurred had the Project been commenced as scheduled . Client also agrees to bear sole responsibility for any expenses incurred by the Artist as a result of Clients' Cancellation of this Agreement at any time . All deposits are nonrefundable.
